EVA Terms of Use — Trial
Effective: (set this to the date you publish it) · Version: 1.0 (trial) Contact: support@evaalert.com
By installing or using EVA you agree to these terms. If you do not agree, do not use it.
1. Read this part even if you read nothing else
EVA IS NOT A SUBSTITUTE FOR DRIVING ATTENTIVELY.
ALWAYS DRIVE ACCORDING TO ROAD CONDITIONS AND IN ACCORDANCE WITH TRAFFIC LAW. Look, listen, and yield to emergency vehicles exactly as you would if EVA did not exist.
EVA MAY FAIL TO WARN YOU. It may warn you late, warn you about the wrong vehicle, warn you when there is nothing there, or say nothing at all. It depends on a mobile network, a GPS signal, a battery, a server, and a phone that has not been silenced — any of which can fail without notice.
NEVER RELY ON SILENCE FROM EVA AS AN INDICATION THAT THE ROAD IS CLEAR.
DO NOT INTERACT WITH YOUR PHONE WHILE DRIVING. EVA speaks its warnings aloud specifically so you do not have to look at it. Using a handheld phone while driving is illegal in Florida and in most other places.
2. What EVA is
EVA warns you that an emergency vehicle may be approaching your position, based on where that vehicle is, where it appears to be heading, and where your phone last reported it was.
It is an experiment, in trial, operated by one person. It is not a product, it is not certified, and it has not been independently validated.
3. Who may use it
- You must be 18 or over.
- You must hold a valid driving licence if you are using EVA while driving.
- You must have been invited to the trial and hold a trial code.
Emergency departments participate under a separate arrangement with the operator.
4. The trial
You are a volunteer. There is no charge, and there is no obligation on you.
- You may stop at any time, for any reason, without notice or explanation.
- We may end the trial, or your participation in it, at any time, without notice.
- EVA may be unavailable, interrupted, or changed without warning. It is under active development and is restarted, reconfigured and updated frequently.
- Features may be added, changed or removed.
During the trial, EVA may record more about your device's movement than it will once it is finished. This is described in §3.1 of PRIVACY.md and is a condition of taking part.
5. What you agree to do
- Use EVA only as a passive warning while driving lawfully.
- Do not use it to locate, follow, intercept, obstruct or avoid emergency vehicles. EVA exists so that you can get out of their way.
- Do not attempt to register as an emergency vehicle unless you are authorised by a participating department.
- Do not attempt to extract another user's position from the service.
- Do not reverse engineer, resell, or redistribute EVA or its data.
Misusing emergency vehicle information may be a criminal offence. Attempting to evade or interfere with emergency services is a serious matter and participation will be terminated immediately.
6. What we ask of you as a tester
Nothing is mandatory, but the trial only produces something useful if participants report problems:
- If EVA warns you about something that was not there, tell us.
- If an emergency vehicle passed and EVA said nothing, tell us — this is the most valuable report of all.
- If something is confusing, tell us.

7. No warranty
EVA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that EVA will be available, uninterrupted, timely, accurate, or error-free, or that any warning will be delivered at all.
8. Limitation of liability
To the fullest extent permitted by law, the operator of EVA is not liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of, or inability to use, EVA — including any collision, injury, loss, delay, citation or damage to property.
You assume full and sole responsibility for your own driving.
Nothing here excludes liability that cannot lawfully be excluded.
9. Your content and your data
You keep any rights you have in what you send us. You grant the operator permission to use the telemetry and reports your device produces to operate, measure and improve EVA.
How your data is handled is set out in PRIVACY.md, which forms part of these terms.
10. Our rights in EVA
EVA, its source code, design and name belong to the operator. See LICENSE. These terms give you permission to USE EVA during the trial, and nothing more.
11. Changes to these terms
We may change these terms. If a change materially affects you, we will tell trial participants before it takes effect. Continuing to use EVA after that means you accept the change.
12. Governing law
These terms are governed by the laws of the State of Florida, United States, and you and the operator submit to the courts of that state.
